How to read this draft
DataTuber is the product name of a developer website and a planned screenshot API. This draft uses "the operator" for whoever legally offers that product. The legal name is still open.
The website at datatuber.com is a preview. Capture, accounts, API keys, storage, and billing are not connected. Sections below separate the preview that exists from the API that does not. A planned feature is not a promise that it will ship, and it is not a description of current processing.
Acceptable Use, Copyright and Takedown, Privacy, Cookies, and the API and Beta Disclaimer are part of this draft set. If a published version of those pages ever conflicts with a published version of these terms on liability, the terms control. None of them applies beyond the law that binds the operator.
Who operates DataTuber
The public site is configured as https://datatuber.com. The planned API host is https://api.datatuber.com/v1/screenshots. That host is not serving the API.
TODO: OWNER/COUNSEL REVIEW. Insert the legal entity name, legal form, registration number, registered address, and the country of establishment. Do not publish this draft under a guessed company name.
When these terms would apply
Browsing the preview does not accept this draft. The sign-in screen does not record acceptance. A future account flow may ask for an explicit acceptance of a published version, including the version string and the time of acceptance. That flow is not built.
If a version is later published, it would apply to use of the website and, once the API exists, to API requests made with an issued credential. Customers who use the service for an organization would need authority to bind that organization.
Eligibility and authority
The website is written for developers. A person who uses it should be able to agree to a contract under the law that applies to them. A person who acts for a company or another organization should have authority to do so.
TODO: OWNER/COUNSEL REVIEW. Set any minimum age, any country restriction, and whether the service is offered only to businesses. This draft states no age threshold and no territory list.
The service
The current product is a public website with:
- Marketing pages and a pricing page with no checkout.
- Draft documentation that is not a stable API contract.
- A sign-in screen that stores an email and sends a verification link.
- A dashboard for a verified account, and a separate dashboard preview filled with sample data.
- A homepage URL field. Capture screenshot sends that URL to this website and shows the returned image. The image is not stored.
- API-key and dashboard captures. A successful image is stored on the account until the account holder deletes it from Settings.
The planned public host is an HTTP API that accepts a public URL and returns a screenshot. That host, api.datatuber.com, is not deployed. Calls that work today go to this website's /api/screenshots route. Draft examples still use a placeholder credential, YOUR_API_KEY, which is not a real key. Viewport presets shown in the interface are desktop, tablet, and mobile. PNG and JPG are draft output formats. Capture uses Cloudflare Browser Rendering. apps/api is also a local capture tool.
Fees
No fee is charged. A free beta plan is recorded on the account so a paid plan can replace it later. There is no checkout, no card form, and no automatic charge. The pricing page says paid plans will not open before January 1, 2027. This draft does not authorize a charge. Refunds, taxes, invoices, and any merchant-of-record arrangement are intentionally absent. They belong in a later paid-launch document, and only after counsel reviews them.
Accounts
Submitting a valid email stores an account and asks this website to send one verification message through Mailgun. The account cannot use the dashboard or an API key until that link is opened. Sign-in is email only. Google sign-in is not offered. There is no password. If Mailgun is not configured, nothing is stored and nothing is sent. This screen does not record acceptance of these drafts.
The account holder is responsible for activity on the account and for keeping access to the inbox used to verify it. A signed-in holder can delete the account from Settings. There is no separate contact form for a compromised account.
API keys
A verified account can create up to five active API keys from the dashboard. The full secret is shown once. The database stores a hash and a short prefix. The masked value in the dashboard preview is still decorative and cannot authenticate. A live key is sent as a bearer token in the Authorization header to this website's /api/screenshots route. api.datatuber.com is not serving that API.
The customer is responsible for keeping keys secret and for requests made with them. A key can be revoked from the dashboard. The operator stores a hash of the secret after creation, not the secret itself.
Permitted use
You may view the public website. When the API is operating, a customer may send requests that the documentation for the issued key allows, for URLs the customer has a lawful basis and any required permission to capture and use.
The operator does not decide that a public URL is lawful for a particular customer to capture. The Acceptable Use Policy is the detailed list of prohibited uses.
Ownership and a limited license
The operator keeps its rights in the DataTuber software, website, brand, and documentation. Those rights do not include the contents of third-party websites.
You keep any rights you already have in URLs, instructions, and other material you submit. A screenshot of someone else's website can be protected by that site's owners and by people shown in the page. The operator does not claim ownership of those images and does not grant you the site owner's rights.
When a capture service is actually processing a request, the customer grants the operator a limited license to access the submitted URL, render the page, and return the image to the customer, only to provide that request. The license is not an assignment. It does not let the operator sell the page or sublicense it to other customers. The current website does not fetch URLs typed into the preview.
Third-party websites
Target websites are not operated by DataTuber. Their terms, robots rules, access controls, and applicable law can restrict capture and reuse. Customers are responsible for complying with those limits. The operator is not a party to the target site's terms.
Restrictions
Do not use the website or, once it exists, the API in a way the Acceptable Use Policy prohibits. That includes unlawful, infringing, abusive, privacy-invasive, or security-harming uses. Do not interfere with the service, attempt to break access controls, or present sample dashboard figures as live account data.
Quotas, rate limits, and suspension
A verified account on the free beta plan can take 100 screenshots in a UTC month, and 6 requests in a minute. The public homepage demo allows 5 captures an hour for a hashed visitor IP, and every capture waits at least 11 seconds behind the previous one. An unverified email cannot use the account. An account can be marked suspended in the database. The notice you would get before a suspension is not set.
A published service may apply fair operational limits, refuse traffic that threatens the service or other people, and suspend access for violations. Any limit should be proportionate to the issue. The numbers and the notice you would get before a suspension are not set.
TODO: OWNER/COUNSEL REVIEW. Confirm whether consumer or unfair-contract rules require prior notice, a chance to respond, or a bar on suspending free users for a minor or mistaken violation.
Beta features and changes
The site is a beta preview. Documentation fields, sample screens, and the planned API can change or be withdrawn. Draft docs are not a stable schema. A feature described as planned may never ship.
Read the API and Beta Disclaimer with this section. Screenshots, once they exist, can be incomplete. They are a poor fit for high-stakes decisions.
Availability
The operator does not offer a service level agreement. No uptime target, support response time, or credit for downtime is included unless a separate written agreement says so. No such agreement is offered. Outages of a future host, of DNS, or of a target website can stop a capture. Maintenance and suspension can stop access too.
Third-party providers
Sign-in messages go through Mailgun when that sender is configured. Screenshot capture goes through Cloudflare Browser Rendering. Account, key, and usage rows are stored in Neon. Page views go through Google Analytics when a measurement ID is configured. The website code does not integrate a payment processor. The production host is not named in the repository. Font files are prepared with the Next.js font tool so a normal page view can be served from the same site. See the Privacy Policy and Cookie Policy.
TODO: OWNER/COUNSEL REVIEW. Name the host and any other processor before stating that a provider list is complete. Do not imply a contract that has not been signed.
Disclaimers
To the extent the law allows, the website and any future API are provided as available, without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of a screenshot, or uninterrupted operation. Some laws do not allow certain warranty disclaimers. In those cases the disclaimer applies only as far as the law allows. Mandatory consumer rights stay in place.
Liability
To the extent the law allows, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. The operator does not exclude liability that a governing law refuses to exclude. That can include liability for fraud, willful misconduct, or death or personal injury caused by negligence, where those limits exist.
No fee is charged, so a cap defined only as "fees paid in the prior 12 months" would be zero. A zero cap can be unenforceable, especially for consumers. This draft states no monetary cap.
TODO: OWNER/COUNSEL REVIEW. Choose the cap, if any, including a specific free-beta treatment, a floor amount if a fee-based cap would be zero, and the consumer and small-business carve-outs. Confirm the clause under the law that will govern, including any standard-form contract rules.
Indemnity
A future published term may ask business customers to cover third-party claims that arise from their URLs, their instructions, or their misuse of the service, including infringement and privacy claims. Any such term needs a clear notice procedure and should not be used where the law protects a consumer from it. This paragraph is a placeholder for that review. It is not an indemnity in force.
TODO: OWNER/COUNSEL REVIEW. Decide whether any indemnity is mutual, whether it is limited to business customers, who controls the defense, and which consumer protections block it. Remove the clause if it would be an unfair term.
Termination
You may stop using the website at any time. A signed-in account holder can delete the account from Settings. That removes the workspace, API keys, sessions, usage counters, and capture rows for that workspace, including stored screenshots. Anonymous demo rows are not tied to an account. Retention of host logs and backups is not defined here.
The operator may stop offering the preview. Once the API exists, the operator may refuse or end access for a serious violation of the acceptable use rules, or where continuing the service would break the law. Proportion and any required notice are part of the review note in the quotas section.
Changes to these terms
Draft text is versioned in source. The version on this page is in the header. A change to the draft creates no duty, because the draft is not in effect.
After a version is in effect, the operator intends to publish the new version, with a new version id, before it applies. Material changes need a notice method and a notice period that counsel approves. Continued use should not be the only form of acceptance if the law requires a clearer act.
TODO: OWNER/COUNSEL REVIEW. Set the notice period, the channel (in-product, email, or both), and whether existing users must take a new affirmative step. Email notice is impossible until an email sender and real accounts exist.
Governing law and disputes
This draft does not choose a governing law, a court, or an arbitration forum. It does not waive class actions. It does not require informal negotiation before a claim, because a contact channel is not published.
TODO: OWNER/COUNSEL REVIEW. Select governing law and venue only after conflicts, consumer, and standard-contract review. Record the choice here. Leave it blank rather than guessing.
If a court refuses to enforce one sentence of a published version, the rest stays in effect where the law allows that result. The operator may assign a published contract only if the published terms say so and the law allows it. This draft grants no assignment.
Other terms
These drafts are not the entire agreement between you and the operator. They are not an agreement. A published set may say that it, together with the documents it names, is the agreement for the service, except for rights that the law keeps in force.
A failure to enforce a published term is not a waiver. Headings are for convenience. The English text is the drafting language. If a translation is published later, counsel should say which language controls.
Contact
No legal contact address is published. Do not send notices to a personal address that is not listed on this page. The operator will add a contact only after it is verified.
TODO: OWNER/COUNSEL REVIEW. Publish a monitored legal contact (an address, an email, or both) and the person or role that reads it. Do not invent an inbox.
